There can be granted asylum if: - there is reasonable risk of inhuman and degrading treatment. (Section 7, 2) The decision is made on an individual assessment of each application.
Definition of 'refugee' in asylum law
Three types of refugees are defined in Denmark: convention refugees, quota refugees and refugees with protection status. The latter is applicable in FGM cases and is defined as:
- people, who do not meet the requirements of the UN Refugee Convention, but still need protection. It can be in risk of death penalty, torture or other degrading and inhuman treatment in their homeland.
