It classifies the convictions having legal effect that are handed down by the Austrian courts in accordance with the Austrian Criminal Code or supplementary criminal laws. In the case of proceedings instituted on account of multiple punishable acts, the conviction is classified according to the offence that is decisive in terms of the punishment imposed (“principal offence”) – this will be changed in 2012. Statistics on reconvictions (Wiederverurteilungsstatistik) are based on persons being legally convicted (expect for unconditional prison sentences) or released from prison in the reporting year. The statistics show how many of these persons were convicted again in the following 4 to 5 years.

Current developments concerning this statistical product are: In the case of proceedings instituted on account of multiple punishable acts, previously the conviction has been classified according to the offence that is decisive in terms of the punishment imposed (“principal offence”) – this will be changed in 2012, therefore from then on all offences will be documented.
